Hereinafter referred to as the “Seller”. The customer, whether an individual or a legal entity placing an order, is hereinafter referred to as the “Customer”.
Our products are presented with the greatest care. Photographs, descriptions and specifications (dimensions, types of wood, finishes, power, etc.) are provided for information purposes only; as some pieces are partly handmade, slight variations in colour, grain or appearance may occur and do not constitute a defect.
Offers are valid subject to availability or, for made-to-order products, under the agreed conditions. The Seller reserves the right to modify its range and prices at any time; confirmed orders remain governed by the conditions in force when they were validated.
Prices are stated in Swiss francs (CHF) and, where applicable, include VAT at the statutory rate in force. Delivery costs, borne by the Customer, are stated in the quote or invoice. On-site collection is free of charge.
For deliveries outside Switzerland, any customs duties, import taxes or customs-clearance charges are borne by the Customer.
The ordering process consists of the following steps: the Customer’s request, discussion of the desired product or configuration, preparation of a quote, acceptance of the quote by the Customer and payment of the first instalment provided for.
The contract is concluded upon receipt of the first payment provided for in the quote. Depending on the project, this first payment may take the form of a deposit; it is neither systematic nor mandatory, and its terms are specified in the quote or invoice.
The Seller reserves the right to refuse or suspend an order for a legitimate reason (unavailability, obvious pricing error, non-payment, suspected fraud, infeasible custom request, etc.).
Certain products are made to order, customised or produced as limited editions. For these products:
An invoice is sent to the Customer. Where a deposit is provided for, the first payment is due in accordance with the terms stated in the quote or invoice. Full payment of the price, including costs, is required before delivery of the product.
In the event of non-payment, the Seller may suspend the order and, where applicable, claim default interest in accordance with the law.
Products are delivered to the address provided by the Customer, after full payment of the price, within the timeframe communicated at the time of the order. These timeframes are indicative; a reasonable delay does not entitle the Customer to cancel or claim compensation, unless otherwise agreed in writing.
Delivery is at the Customer’s expense. Delivery costs and arrangements are stated in the quote or invoice. The Customer may also collect the product free of charge on site, under the arrangements agreed with the Seller.
The Customer must check the condition of the parcel upon receipt and promptly report any apparent damage to the carrier and the Seller. The risk of loss or deterioration transfers to the Customer upon delivery of the product.
Products remain the property of the Seller until the price and all costs have been paid in full.
Swiss law does not provide for a general statutory right of withdrawal for distance sales.
No commercial return or exchange is accepted, including for standard products. The Customer’s rights in the event of a defect are addressed in Article 10.
After payment of a deposit, the order may not be cancelled.
The Seller grants a two-year warranty from delivery against manufacturing defects affecting the product.
In the event of a defect, the Customer must notify the Seller without delay after discovering it, describing the problem. Depending on the nature of the defect, the Seller may offer repair, replacement, a price reduction or, where applicable, cancellation of the sale.
The warranty excludes normal wear and tear, damage resulting from improper use, lack of maintenance, modification by the Customer or a third party, and natural variations specific to solid wood (see Article 2).
The Seller is liable for damage caused intentionally or through gross negligence. To the extent permitted by law, all liability for indirect or consequential damage is excluded. Mandatory statutory provisions, in particular concerning product liability and personal injury, remain reserved.
The Seller shall not be liable for non-performance or delay resulting from force majeure or events beyond its control (disaster, strike, supply interruption, failure of a supplier or carrier, etc.).
The Customer’s personal data is processed in accordance with our Privacy Policy, established under Swiss data-protection law.
These Terms and Conditions and any contractual relationship between the Seller and the Customer are governed by Swiss law, excluding conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
Subject to mandatory jurisdictions provided by law, particularly those protecting consumers, the exclusive jurisdiction is Le Bry, Switzerland.
If any provision of these Terms and Conditions is declared null or unenforceable, the remaining provisions shall remain fully valid. The Seller reserves the right to amend these Terms and Conditions; the applicable version is the one in force at the time of the order.
